Introduction

Get My Car LLC (“Get My Car,” “we,” “us,” or “our”) operates getmycar.nyc and provides a text-message-based vehicle retrieval service to parking garages, valet operators, and similar facilities (each, a Garage Partner).

This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices available to you. It applies to visitors to our website, individuals who use our text messaging service to request a vehicle (Customers), and personnel of our Garage Partners who access our platform (Attendants).

By using our website or our text messaging service, you agree to the practices described in this Policy. If you do not agree, please do not use the service.

How our service works, and our role

Get My Car provides a messaging relay service on behalf of Garage Partners. When you text the number posted at a participating garage to request your vehicle:

  1. Your message is received by Get My Car's platform;
  2. A retrieval request is transmitted to the Garage Partner where you parked;
  3. An Attendant at that garage acknowledges or confirms the request; and
  4. The request appears on the garage's internal request board so staff can retrieve your vehicle.

Our role

For the vehicle retrieval requests you send, Get My Car acts as a service provider to the Garage Partner. The Garage Partner determines the purposes for which retrieval information is used; we process it on their instructions and under contract with them. The Garage Partner may have its own privacy policy governing its use of that information, and we encourage you to review it.

For our own website, our platform accounts, our billing records, and our internal service operations, Get My Car acts as the controller of that information and is responsible for it directly.

Information we collect

Information you provide through text messaging

When you text our service, we collect:

  • Your mobile telephone number
  • The content of messages you send us, including any ticket number, spot number, vehicle description, name, or other details you choose to include
  • Timestamps of messages sent and received
  • The Garage Partner location associated with the number you texted
  • Your consent and opt-in status, and any opt-out (STOP) or help (HELP) requests

Information we receive from Garage Partners

Garage Partners may provide us with information necessary to fulfil a request, such as a ticket or claim number, a parking spot or stall identifier, vehicle make, model and color, and request status (received, acknowledged, in progress, ready).

Diagnostic and error records

When something goes wrong in delivering a request — a message sent to a number we do not recognize, a database error, an unexpected fault — our systems record the details needed to investigate it. Those records may include the mobile number the message came from and the content of the message. They are held by our error monitoring provider, Axiom, Inc., and are described further in Sections 6 and 8.

Information we collect automatically from our website

  • IP address and general location inferred from it (city or region level)
  • Browser type, operating system, and device type
  • Pages viewed, referring URL, and dates and times of access
  • Cookies and similar technologies (see Section 7)

Information you submit through our website

If you complete the pricing request form on our website, we collect the name, company, email address, phone number, number of locations, and current equipment you provide, along with any message you write. This is business contact information submitted by people enquiring about our service on behalf of a parking operator. Providing a phone number is optional.

Attendant and business contact information

If you are an Attendant, garage manager, or business contact, we collect your name, work email address, work phone number, employer, job role, and account credentials, along with records of actions taken in the platform — such as which Attendant acknowledged a request.

Information we do not collect

We do not collect precise GPS location from Customers. We do not collect payment card numbers from Customers through the text messaging service. We do not knowingly collect information from children under 13.

How we use information

We use the information described above to:

  • Receive, route, and fulfil vehicle retrieval requests
  • Display request status on a Garage Partner's request board
  • Send you transactional text messages confirming receipt and status of your request
  • Respond to HELP requests and honor STOP requests
  • Provide customer and technical support
  • Respond to pricing requests and other enquiries submitted through our website, and follow up about the service you asked about. We do not add people who submit that form to a marketing list, and we do not sell or share those details with anyone outside the vendors listed in Section 6.
  • Maintain, secure, monitor, troubleshoot, and improve our platform
  • Generate aggregated or de-identified analytics and operational reporting for Garage Partners, such as average retrieval time or request volume by hour
  • Detect, investigate, and prevent fraud, abuse, spam, and violations of our Terms of Service
  • Comply with legal obligations, including messaging and telecommunications regulations, and enforce our agreements

What we don't do with it

We do not use the mobile phone numbers or message content collected through the retrieval service to send you marketing or promotional messages, and we do not use them to build advertising profiles.

Text messaging privacy

This section applies specifically to our SMS text messaging program. Please also see our SMS Terms.

Mobile information sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as our messaging provider or customer service vendors, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We do not sell your information

We do not sell, rent, or lease your mobile phone number, your SMS consent, or the content of your messages to anyone.

Consent

By texting our service number, you consent to receive text messages from Get My Car relating to your vehicle retrieval request. Consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies based on your activity.

Opting out

You may opt out at any time by replying STOP to any message. You will receive a single confirmation message and will not receive further messages unless you opt back in by texting START. For help, reply HELP or contact us at the address in Section 15.

Please do not text sensitive information

The messages you send are visible to authorized personnel at the garage where you parked, as described in Section 6. Send only what is needed to retrieve your vehicle, such as your ticket or spot number. Do not text payment card numbers, government identification numbers, financial account details, health information, or other sensitive personal information. Text messaging is not an encrypted or confidential channel.

Carrier liability. Wireless carriers are not liable for delayed or undelivered messages.

All vendors are bound by contract to use information only to provide services to us and to protect it appropriately.

What garage personnel can see

To fulfil your request, Attendants and managers at the Garage Partner where you parked can view your request through an access-controlled staff console. The console shows your ticket or spot identifier, the time you asked for, the status of your request, and any note an Attendant has added. An Attendant can open an individual request to see the mobile number you texted from and the content of the messages you sent. This is necessary so that staff can identify your vehicle, ask clarifying questions, and confirm when it is ready.

Access is limited to authorized personnel of the specific garage associated with your request. Attendants cannot view requests belonging to other garages.

Where the console is displayed

The staff console usually runs on a monitor or tablet in the garage booth or attendant area. Depending on where a Garage Partner has mounted that screen, the requests shown on it may be visible to other people in the garage, including other customers. What is visible at a glance is the identifier, the requested time, the status, and any Attendant note; your phone number and your message content are shown only when an Attendant opens an individual request.

Our contracts with Garage Partners require them to limit console access to personnel with a legitimate need to fulfil retrieval requests. If you are concerned about what is displayed at a particular garage, contact that garage directly.

Request boards

Separately from the staff console, Garage Partners may display pending requests on a board or screen that can be seen by people in the garage, including other customers. Boards are configured to show only a ticket, spot, or claim identifier and request status — not your phone number and not your message content.

Cookies and analytics

Our website uses cookies and similar technologies to operate the site, remember preferences, and measure traffic. You can set your browser to refuse cookies, though some site features may not function properly as a result.

We honor Global Privacy Control (GPC) signals where required by applicable law. We do not use cookies for cross-context behavioral advertising.

Data retention

We keep information for as long as it is needed for the purposes described in this Policy, and thereafter as needed to comply with legal obligations, resolve disputes, and enforce our agreements.

We do not currently delete records on a fixed schedule. Instead, we decide how long to keep information using the following criteria:

  • Whether the service relationship is ongoing. Retrieval records are retained while we provide the service to the garage where you parked.
  • Whether we need the record to honor your choices. Opt-out records are kept indefinitely, because we cannot honor your request not to be messaged if we delete the record of it.
  • Whether we need the record to show you consented. The first message you send us is the record that you asked to receive texts. Claims about text messaging can be brought years after the fact, so we retain that record accordingly.
  • Whether an enquiry is still live. Pricing requests submitted through our website are kept while we are in contact with you and afterwards as a record of the enquiry. You can ask us to delete yours at any time.
  • Whether the record is needed for a dispute or a legal obligation, including a dispute between you and a garage about a request you sent.
  • Whether a Garage Partner's contract requires it. Retention of information we process on their behalf may also be governed by that contract.
  • Whether the record is a diagnostic log. Error records held by our monitoring provider are deleted automatically 30 days after they are created. They are not organized by person and are not searchable by phone number, so we cannot reliably locate and remove an individual's information from them on request — they expire on the schedule above instead.

You may ask us to delete information about you at any time — see Section 10. We will do so unless we are required to keep it for one of the reasons above, and we will tell you if that is the case.

Data security

We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. These include encryption of data in transit, individually credentialed Attendant accounts, access controls that limit each Attendant to the requests of the garage they are assigned to, logging of platform activity so that access to a request is attributable to a specific account, prompt deactivation of accounts when personnel leave a Garage Partner, and periodic review of our security practices. Our contracts with Garage Partners require them to limit console access to personnel with a legitimate need to fulfil retrieval requests.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your personal information, we will notify you and applicable authorities as required by law, including the New York SHIELD Act.

Your choices and rights

Regardless of where you live, you may:

  • Stop text messages by replying STOP to any message
  • Request access to the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your information, subject to legal and operational limits — note that we must retain opt-out records, and that diagnostic logs expire on the schedule described in Section 8 rather than on request

To exercise these rights, contact us using the details in Section 15. We will verify your identity before responding, typically by confirming control of the phone number or email address at issue. We will not discriminate against you for exercising your rights.

If your information was processed on behalf of a Garage Partner, we may direct your request to that Garage Partner, or respond on their behalf as our contract requires.

State privacy rights

California residents

Under the California Consumer Privacy Act, as amended, you have the rights to know, delete, and correct personal information, to opt out of the sale or sharing of personal information, and to limit the use of sensitive personal information.

We do not sell or share personal information as those terms are defined by the CCPA, and we have not done so in the preceding 12 months.

We do not use or disclose sensitive personal information for purposes other than those permitted without a right to limit. Categories of personal information we collect are described in Section 3; the sources, purposes, and recipients are described in Sections 3, 4, and 6. You may designate an authorized agent to make a request on your behalf.

Other states

Residents of states with comprehensive privacy laws — including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others as such laws take effect — may have rights to access, correct, delete, and obtain a portable copy of their personal information, and to appeal a denial of a request. To appeal, reply to our response or contact us at the address in Section 15.

New York residents

We comply with the New York SHIELD Act's data security and breach notification requirements.

Children's privacy

Our service is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child under 13 has provided us information, contact us and we will delete it.

Changes to this policy

We may update this Policy from time to time. We will revise the “Last updated” date above and, if changes are material, provide additional notice through our website or by text message where appropriate. Your continued use of the service after the effective date constitutes acceptance.
