Agreement to these Terms

These Terms of Service (Terms) are a binding agreement between you and Get My Car LLC (“Get My Car,” “we,” “us,” or “our”). They govern your use of getmycar.nyc (the Site) and our text-message-based vehicle request service (the Service).

You accept these Terms by using the Service, including by sending a text message to a Get My Car number posted at a participating garage, or by using the Site.

Please also review our Privacy Policy and our SMS Terms, each of which is incorporated into these Terms.

If you do not agree to these Terms, do not use the Service. You can always request your vehicle by speaking with an attendant in person.

What Get My Car is — and what it is not

Get My Car is a communications technology provider. We operate a messaging platform that relays vehicle retrieval requests between customers and the parking garages, valet operators, and similar facilities we contract with (each, a Garage Partner).

Get My Car does not

Own, operate, manage, or staff any parking facility
Park, move, retrieve, drive, store, or handle any vehicle
Take possession or custody of any vehicle, key, fob, or parking ticket
Employ, supervise, train, or control garage attendants or any other garage personnel
Set parking rates, hours, policies, or terms
Charge you any fee for the Service

No bailment

Nothing in these Terms and nothing about your use of the Service creates a bailment, custodial relationship, or duty of care between you and Get My Car with respect to your vehicle or its contents. Your vehicle is in the custody of the Garage Partner, not Get My Car.

Your parking relationship is with the Garage Partner

The terms of your parking — including rates, liability for loss or damage, retrieval times, hours of operation, claim procedures, and the terms printed on your ticket or posted at the facility — are set by the Garage Partner and are between you and the Garage Partner. Get My Car is not a party to that relationship.

Eligibility

To agree to these Terms on your own behalf, you must be at least 18 years old.

If you are old enough to hold a valid driver's license in your jurisdiction but are under 18, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the Service.

We do not knowingly permit anyone under 13 to use the Service.

How the Service works

When you text a Get My Car number posted at a participating garage:

We receive your message;
We relay a retrieval request to the Garage Partner where you parked;
An attendant at that garage acknowledges the request;
The request appears on the garage's internal system so staff can retrieve your vehicle; and
We may send you messages confirming receipt and status.

We relay requests. We do not fulfil them.

Whether, when, and how your vehicle is actually retrieved is entirely within the control of the Garage Partner and its personnel. A confirmation from our system means your request was transmitted — not that your vehicle is ready, and not that a garage has agreed to any particular retrieval time.

Text messaging

Full details are in our SMS Terms. In summary:

By texting our number, you consent to receive text messages from Get My Car relating to your request.
Consent is not a condition of any purchase.
Message and data rates may apply. Message frequency varies with your use of the Service.
Reply STOP to opt out; reply HELP for help.
Wireless carriers are not liable for delayed or undelivered messages.

Phone number representations

You represent that you are the subscriber of, or an authorized user of, the mobile number you text from. If you give up, transfer, or change that number, you agree to notify us at info@getmycar.nyc so we can stop sending messages to it.

Do not send sensitive information

Messages you send are visible to authorized personnel at the garage where you parked. Send only what is needed to retrieve your vehicle. Do not send payment card numbers, government identification numbers, financial account information, or health information.

Not for emergencies; do not rely solely on the Service

The Service is not an emergency service

Do not use it to report an emergency, a crime, a medical situation, a fire, an accident, or any circumstance requiring urgent assistance. In an emergency, call 911 or contact garage personnel directly.

Do not rely solely on text messaging. Text messages can be delayed, misrouted, or never delivered, for reasons including carrier conditions, network outages, device settings, spam filtering, and matters outside our control. If your vehicle is not ready when you expect it, or if you do not receive a response, speak with an attendant in person.

Acceptable use

You agree not to:

Submit false, fraudulent, or unauthorized retrieval requests, or request a vehicle you are not authorized to take possession of
Impersonate any person, or misrepresent your identity or your affiliation with any person or vehicle
Use the Service to harass, threaten, abuse, defame, or send obscene or unlawful content to garage personnel or anyone else
Use automated systems, bots, or scripts to send messages to our numbers
Attempt to probe, scan, disrupt, overload, reverse engineer, or gain unauthorized access to the Service, the Site, or any related system
Use the Service for any unlawful purpose or in violation of any applicable law or regulation
Scrape, harvest, or collect information from the Site or the Service without our written permission

We may suspend or terminate access to the Service for any person who violates this section, without notice.

Availability, and no guarantee of delivery or timing

We do not guarantee that the Service or the Site will be available, uninterrupted, secure, timely, or error-free. We do not guarantee that any message will be delivered, delivered on time, or received by any particular person.

Availability depends on factors outside our control, including wireless carriers, internet service providers, messaging vendors, hosting providers, garage equipment and network conditions, garage staffing, and force majeure events.

We may modify, suspend, or discontinue the Service or any part of it at any time, including at a particular garage if our agreement with that Garage Partner ends.

Vehicles, property, and garage conduct

To the fullest extent permitted by law, Get My Car is not responsible or liable for:

Loss, theft, damage, or vandalism to your vehicle or anything in it
Delay in retrieving your vehicle, or failure to retrieve it
The condition of your vehicle when returned
Release of a vehicle to a person not authorized to receive it
The acts, omissions, negligence, or misconduct of any Garage Partner or its personnel
Parking rates, fees, charges, overcharges, or billing disputes
Personal injury, property damage, or any incident occurring at a parking facility
Any dispute between you and a Garage Partner

Claims arising from any of the above should be directed to the Garage Partner. We will, on reasonable request, provide records of messages relayed through our platform to assist in resolving such a dispute, subject to our Privacy Policy and applicable law.

Intellectual property

The Site and the Service, including our software, platform, text, graphics, logos, and the marks “Get My Car” and “getmycar.nyc,” are owned by Get My Car or its licensors and are protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.

Third-party services

We use third-party providers — including Twilio Inc. for message transmission — to operate the Service. Your use of the Service may also be subject to your wireless carrier's terms. We are not responsible for the acts, omissions, terms, or policies of third-party providers or carriers.

Disclaimer of warranties

The Site and the Service are provided “as is” and “as available,” without warranties of any kind, express or implied.

To the fullest extent permitted by law, Get My Car disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, that defects will be corrected, or that messages will be delivered.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the fullest extent permitted.

Limitation of liability

To the fullest extent permitted by law, Get My Car and its officers, members, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Site or the Service, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

In no event will our total aggregate liability arising out of or relating to the Site or the Service exceed the greater of (a) the total amount you paid to Get My Car in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

You acknowledge that the Service is provided to you at no charge and that these limitations are a fundamental basis of our agreement.

Relationship to Section 9

The cap in this section applies to claims concerning Get My Car's own conduct in operating the Site and the Service. It is not a concession of responsibility for anything disclaimed in Section 9, which is a complete disclaimer of liability for vehicles, garage operations, and the acts and omissions of Garage Partners and their personnel.

Nothing in these Terms limits liability that cannot lawfully be excluded or limited, including liability for gross negligence, wilful misconduct, or fraud where applicable law does not permit exclusion. Some jurisdictions do not allow certain limitations; in those jurisdictions, the above applies to the fullest extent permitted.

Indemnification

You agree to indemnify, defend, and hold harmless Get My Car and its officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, your violation of any law, or your infringement of any third party's rights.

Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to participate in a class action.

Informal resolution first

Before starting a formal proceeding, you agree to contact us at info@getmycar.nyc and describe your dispute, and to give us 30 days to resolve it informally.

Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms, the Site, or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in New York County, New York, or by telephone, videoconference, or on documents only, at your election. The Federal Arbitration Act governs this section.

Class action waiver

You and Get My Car agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Small claims exception

Either party may bring an individual claim in small claims court if it qualifies.

Your right to opt out

You may opt out of this arbitration agreement and class action waiver by emailing info@getmycar.nyc with the subject line “Arbitration Opt-Out” within 30 days of first using the Service. Include the mobile number you used. Opting out will not affect any other part of these Terms, and will not affect your use of the Service in any way.

Severability

If the class action waiver is found unenforceable as to a particular claim, that claim will proceed in court and the remainder of this section will remain in effect.

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Subject to the dispute resolution section above, you and Get My Car submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

Changes to these Terms

We may update these Terms. We will post the revised version with a new “Last updated” date. If changes are material, we will provide additional notice through the Site or, where appropriate, by text message. Changes are not retroactive. Your continued use of the Service after the effective date constitutes acceptance.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms or if our agreement with the relevant Garage Partner ends. The sections covering our role, vehicles and garage conduct, intellectual property, warranty disclaimers, liability, indemnification, dispute resolution, and these general provisions survive termination.

General

Severability. If any provision is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, financing, or sale of assets.
Entire agreement. These Terms, with the Privacy Policy and SMS Terms, are the entire agreement between you and Get My Car regarding the Service, and supersede any prior agreements on that subject.
No third-party beneficiaries. Except that Garage Partners are intended third-party beneficiaries of the sections describing our role and disclaiming vehicle and garage liability, these Terms create no third-party rights.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
Notices. We may provide notice to you by text message to the number you used or by posting on the Site. You may give notice to us at info@getmycar.nyc.
Relationship. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Get My Car.
